Accident Rights

I was involved in a fatal accident and the other driver was at fault. The police held me at the scene for 2 hours and then took me to the police station for a statement and read me my rights.I was finally released 3 1/2 hours later to go to the hospital to be checked out. Since the accident I am scared to drive and I was afraid I would be arrested. Since then no charges were filed and the insurance is trying to settle real fast. What are my rights with the insurance and do I have a case against the city for my treatment at the accident.

First, the insurance company is the one paying out their money on this accident, and they will make arrangements without your knowledge or say so. It only becomes important if your legal interests are compromised. Since the other driver was at fault, it is not likely that your legal interests will be compromised by the insurance company.

Secondly, the police have the right to investigate an accident particularrly when a fatality occurs. Usually, they will keep you at the scene for as long as it takes to determine if you have any criminal fault in the accident.
