Legal Question in Personal Injury in Texas

accident settlement agreement

had an accident on site at walmart, they offered cash plus taking care of all med bills...I accepted their offer...there are $900 on bills they are refusing to pay, they claim it is my deduc. and that I must pay it out of my settlement...I was decived by the agent who explained the agreement to me, they will not return my calls.. I should not have to pay the bills they claim they were going to pay, I would not have the deductable if it were not for the accident. I feel taken advantage of.

If you signed a release, then you are bound by the terms of the release. Regardless, you should talk to an attorney in more detail about your claim.

If the agreement is in writng, you may have a breach of contract...see a lawyer

With all due respect to Mr. McLeaish, I'm sure he doubts, as I do, that Wal-Mart's agents would put such an agreement in writing. There is no question you have been deceived and you have no proof of it. That is how Wal-Mart takes care its responsiblities to accident victims on their premises and they pride themselves on such conduct. The agent you were talking to probably got a gold star for his/her actions. Welcome to Wal-Mart.
