Legal Question in Personal Injury in Texas

animal bite

I hired a dog trainer about a year and a half ago, because my 1yr old pit bull was becoming aggressive. She aggreed to train him, and came to my house. Well, when she told me to let him out of my bedroom, he slipped out of his leash and bit her on the arm. She had to have 4 stitches. Now she is telling me if I dont pay for her medical bills, she will sue me for them, and for the time and money she lost in her job after the bite. Can she do that since, she knew before hand that i had an aggressive dog, and she came into my house????

Re: animal bite

She as well as anyone else can sue with or without any good reason. Whether she can win is a different question. A first inquiry should be whether you have home owners insurance. Most home owners policies will cover medical expense up to a $1,000 or so which relate to injuries incurred by guests on your property, even though there is no fault. Above that fault must be shown. Given the unique circumstances it may be difficult for her to achieve victory at the courthuse -- why, because she was warned, she is an expert and elected to assume the risk (an element of contributory negligence in Texas).
