Legal Question in Personal Injury in Texas
Assault
We where at a party and a huge fight broke out. It started with two guys. They were asked to leave. They headed out and then returned. Our friend walked out to meet them, asked them niceley to leave. Shook one guys hand and reached to the other and he struck to the ground. I grab the guy who hit my friend who puts me in a headlock, drops us both to the ground. I begin hitting him. At this point his girlfriend jumps on my back and starts beating me in the back of the head. I kept on with her boyfriend. Then my girlfriend pulls her off of me. The girl then turned and hit my girlfriend and came back and started kicking me in the head. Then my girlfriend grabs her again and kicks her. Which either chipped or knocked the girls tooth out. They ended up arresting my girlfriend for assault. The girl who claims she lost a tooth said she was an innocent by stander and the cops claimed she was the only victim of the whole scence. My girlfriend only ended up with Disorderly conduct. But, the girl is now pressing charges on my girlfriend. I don't see how since she was fighting and provoaked my girlfriend by hitting her and kicking me in the back of the head. Will this stand in court?
