Legal Question in Personal Injury in Texas

Auto Accident

I had a car accident in Aug 06 and the insurance company will not give me the money to have my car fix. And they will not pay me for my lost wages. My estimate for my car was $700.00 plus and they only gave me $300.00. And my back still hurt. Can they be made to pay for my car and pain and suffering

Re: Auto Accident

It depends on the circumstances. If you are making a claim on your own insurance for uninsured motorist coverage, you can sue your insurance company for bad faith if they do not make a reasonable offer.

If the carrier is the insurance company for another party, you cannot sue that company, but you would sue the party who caused the accident. Without an attorney, you have very little leverage to negotiate. If you are still hurting, are you receiving medical treatment?
