Legal Question in Personal Injury in Texas

Auto Accident

I was in an auto accident. My car was totaled and I was under doctors care and unable to work for 7 months. The guy was cited for failure to yield the right of way. His insurance paid for the totaled car. My medical bills are just over $10,000. What am I entitled to as far as pain and suffering is concerned.

Assuming you did not release the insurer and the 2 year statute of limiations has not expired, you can sue for reimbursement of lost wages, meedical expenses, and pain and suffering. There is no set formula to determine the value of pain and suffering. Factors include the extent of the injury, as well as the period of time involved and whether there is a likelood of additional pain in the future.

Don't do this yourself. There are many factors to cosider: the amount of proprty damage, the nature of injury (soft tissue vs. broken bones), objective findings, etc. Most law offices will review your case for free and wont charge you unless you collect more than you otherwise would.
