Auto accident claim for medical expenses

We were involved in an auto accident which was not our fault and this has been determined as well by the other party's auto insurance. They have decided on a quote they will pay for our car damages. Yet, for the medical expenses, we used our medical insurance to pay for the ER visits and doctors visits. What are we entitled to regarding medical expenses...what we spent out of pocket? We paid co-pays at the ER and doctor's offices. What are we entitled to and how can we make sure we get what we are entitled for as far as pain and suffering? Thank you.

You should be repaid for all of your out of pocket expenses, including copays, deductibles, car rental expenses, etc. by the insurance company of the person who caused the accident.

As for pain and suffering, you may be entitled to reimbursement. This depends on the extent of your injuries.

Insurance companies will sometimes offer a fair settlement to compensate you for the damages to your vehicle and your pain and suffering. If the insurance company does not deal fairly with you, you may need to hire an attorney to protect your rightful interests.

I'd suggest attempting to resolve this directly with the other drivers insurance company before hiring legal assistance. Only if the insurance company fails or refuses to handle your accident fairly would I seek to hire an attorney.
