Auto Accident

I was involved in an auto accident a couple of months ago (01/08) where and individual collided into my vehicle attempting to negotiate a turn. My vehicle was rendered a ''total loss'' by his insurance and they payed x dollars according to the ''Blue Book'' value. Unfortunately, x does not cover the total amount I owe on the vehicle. Is the deficit recoverable against the driver in small claims court?

Generally, if you have settled your case and relinquished your rights; then you might not be able to proceed with any further actions. Typically, you can either go after the insurance company or the individual, but not both. You should review the terms of your settlement agreement.
