Auto Accident Involving a Possession Charge

In late November I was involved in a MVA that was the other driver's fault. At the time of the accident he was issued a citation for ''possession of drug paraphernalia'' I also suffered a miscarriage that followed 2 days after the wreck. The car was totalled and I took an ambulance to the hospital with my 4 year old son who was involved also.

I am having a difficult time figuring a reasonable amount to settle for. He has full coverage. They paid off my car. But I lost my job as a direct result with a domino effect of late bills etc...My family is saying 50-60K settlement is that too much? I suffered severe upper and lower extremity contusions. My son had a mild bumb on his head. Please Help..What should I settle for?

Coming up with a meaningful estimate of how much a case is worth requires review of a number of facts. Much more information is needed than what you've provided. DO NOT DO THIS CASE YOURSELF! This is a serious case, and should be handled by a professional who does these cases for a living. Most attorneys (myself included) will review your case with you at no charge. I strongly recommend your having the case reviewed and your retaining counsel.

We had a case where All State offered $40,000 to settle a claim in March 2007...statute ran in April, so claimant hired us...and in September, All State paid $100,000 plus he had $100,000 UIM which also paid...BUT you need to visit a lawyer..and discuss..what you want and what they offer are two different things. Your family cannot go to Court for you...and generally a lawyer will get more than is offered....
