Legal Question in Personal Injury in Texas

What can I do?

I was in an auto accident on Jan. 12, a ford ranger rear ended me. I did attain a lawyer being as I was in pain. After a mri we found I have 3 bulging disks. But, the lawyer hasn't done anything else. He's never in the office and doesn't return my calls. I'm off work now due to the injurys sustained, and the lawyer has been no help in advice or answering questions. What can or should I do in this situation?

It is always my suggestion that a client attempt to resolve his differences with his attorney before changing lawyers. I suggest you make an in-person appointment with your attorney and ask all the questions you need answered. If, after your meeting, you still are dissatisfied with your attorney's representation, by all means hire another lawyer who will be more responsive to your requests for information. It is your right to be informed of all significant developments in your case.

Fire the lawyer and find somebody who can do this job for you. I know there are 100+ lawyers around the corner who can do this for you. Your case has some value. I don't know why your lawyer isn't doing anything. Could be because you expecting too much to fast. Six weeks is not a lot of time to get something going. These things are not resolved that quickly. But he, or his assistant, should be able to tell you what's happening.

If you are unable to communicate with your attorney in a manner that is satisfactory to you, you can fire the attorney and get a new one who is more responsive. During a typical case, there is a flurry of activity in the beginning (getting the property damage done, coordinating with medical providers, etc.) After that, there is a lull while the client treats. If you haven't completed treatment, there might not be much to do on the matter until you are complete. However, you deserve to have your phone calls returned. You should interview a few attorneys to see who is a better "fit" with you. Most attorneys (myself included) will conduct such an interview at no cost or obligation. Good luck.
