Legal Question in Personal Injury in Texas
Auto accident, U/M, and UIM involved. UIM insurance refused to pay. Filed suit against the insurance company but another company responded. Can I file a judgment against the party who failed to respond?

The other insurance company may be a subsidiary. Look at the Dec page for the name of the Ins Co. who has contracted with you. You will need the contract to prove the contract when you move for a default on the contract claim. However you must obtain a judgement against the UI Motorist first before your carrier becomes legally liable for the damage such that you can collect damages from the carrier.
