autoaccident reimbursement

auto accident-other party at fault. insurance company made initial offer to settle that did not cover total expenses,but it did offer''pain/suffering'' offer.insurance will not respond to written notice of intent to file suit. how can i file in texas, and what forms do i need? if i hire lawyer, can i pay as i go, or do i need to pay a %?

It depends on the amount of damages you have (medical, property). Most attorneys will discuss your case with you for free (our office included), so you should take advantage of that. If the damages are high enough, then most personal injury offices will not charge you anything unless they are able to collect for you on your bodily injury claims. If it is a small case, then some attorneys will charge you a small flat fee to take it to trial in small claims court (note you don't have to have an attorney in small claims court, it's optional.) Additionally, the property damage portion of your claim is typically handled at no cost if there is a bodily injury claim. I invite you to call our office to discuss this further.

If you have significant bodily injuries (that is, medical bills totaling a few thousand dollars), any competent personal injury lawyer will take your case on a "contingency fee" basis and you will not have to pay the attorney until the case is settled. If you have less than a few thousand in bills, you're probably better off suing in the Justice of the Peace Court. You can do that yourself without a lawyer and the clerks at the court will show you what forms you need and will help you fill them out. Good luck to you.
