Legal Question in Personal Injury in Texas

automobile accident

We were in an automobil accident, we do not have no auto insurance. The other person was at fault because he failed to stop at intersection. Will his insurance be liable for our automobil damage as well as my daughters injuries, since my daughter was also hurt?

Re: automobile accident

Assuming no fault on your part which contributed to the collision, yes, the party clearly at fault is liable for the property damage and the personal injury, and those items are routinely covered by insurance. The fact that you were uninsured is not legally significant in this context.
