Automobile Accident Information
I was invovled in an automobile accident in Texas and the other driver was cited with a failure to yield the right of way. I was seriously injured and will be in physical thereapy and rehabilition for six months with the inability to work during that time. He has liability coverage with a policy limit of $40,000 per accident for bodily injury, but my medical bills far exceed this amount and I had no coverage at the time of the wreck. What are my options in order to recover all of my losses?

Unfortunately, what "a policy limit of $40,000.00 per accident" means is only $20,000.00 per person. (The $40,000.00 is the total of what would be paid to all persons if more than one person were injured.) If you hire an attorney at all (and it is doubtful you need one under these circumstances) you should have an agreement with the attorney that his fee will be taken only after all medical bills have been paid. This will give your attorney incentive to obtain major reductions on your behalf. (Now is not the time to lecture you, but this situation could have been avoided had you carried "uninsured/underinsured motorist coverage" on your vehicle. It would have kicked in after the liability limits of the other driver were exhausted. Remember these facts in Texas: 1/3 of all drivers have no insurance at all and, of those who do have coverage, 85% only carry the minimum policy of $20,000.00 as this person did. UM/UIM is absolutely essential coverage to have in these days and times.) Good luck to you.

You'll need an attorney to negotiate to get the maxium amount available from the at-fault driver and then reduce the medical providers' bills so that you can be fully compensated. If there still isn,t enough to go around, you can always sue the driver(just make sure there are assets you can collect against)

Both attorneys..ie Dallas and Houston gave you good advice...sometimes we collect policy limits within a few weeks..and if insurer doesn't pay, then after a lawsuit they may have to pay all your damages, ie medical bills, lost income, future,..etc..etc..so contact a lawyer in your area who is a member of local trial lawyers or Texas trial lawyers...
