Auto-Pedestrian accident
My wife was jogging and was struck by an automobile. The driver appeared to be at fault. Right now I'm not sure, because I haven't gotten the accident report. Should I contact the driver's insurance company to make the claim, or should I consult an attorney and let them contact the insurance company and make the claim/suit? My wife's leg was broken and required surgery. It is projected that she will be off from work for 3-4 months according to the physician.

I would tell you to contact a lawyer and here is why:
1. She was jogging and that raises some issues about contributory negligence.
The insurance company will try to claim that she was at least partially at fault.
2.The second reason is that the medical bills and the time off work mitigate toward a higher settlement and insurance companies hate to pay those.

In these types of cases, you are almost always better off with a lawyer. First of all a good personal injury lawyer is a specialist in these types of claims and can usually get you more money for your medicals and associated claims than you can get for yourself. Insurance companies don't take you seriously and usually give you a low ball offfer to settle. Given that yourw wife has severe injuries and that the insurance company is probably going to argue that your wife was partially if not completely at fault, I would strongly suggest that you contact an attorney. The insurance company will not pay you a fair settlement if you are unrepresented. There are a too many issues for you to try to handle without representation.
