Legal Question in Personal Injury in Texas
The babysitter and a barber decided to shave my 2 year old granddaughter head completely bald. This was after my daughter gave the sitter permission to have her hair cut NOT to shave her bald. Can any legal action be taken because the parents werent there? The barber said that my granddaughter had head lice crawling in the her brain thru big sores on her scalp. And it had to be done. My granddughter has a few tiny scratches on her scalp. (got pics). I think it was a cruel and mean act to bully a little toddler. My daughter is very upset and constantly crying.

Your daughter gave permission to someone else to have her child's hair cut. Hair cuts are a matter of personal taste. The barber did what he was asked/authorized to do by the adult who was present. Fire the babysitter, switch barbers and learn from the mistake of letting someone else take your child to get a haircut.
What did your daughter say and who did you say it to? I assume she gave permission to have your granddaughter's hair cut, not shaved. So, the sitter exceeded her authority. The sitter, however, may argue that the barber believed it necessary to shave because of the lice. Nonetheless, your daughter should have been asked. Your daughter could file in small claims court, but there's a fair chance she would lose and, even if she won, a damage award would likely be small and uncollectible. Also, it would add to the unpleasantness of this whole mishap.
