Legal Question in Personal Injury in Texas

My car was run into in the parking lot where I work. The guy passed-out with his foot on the accelerator, subsequently smashing my car into cement My car is totaled. I have liability and the guy who hit me has State Farm, which is STILL (after two weeks) not sure of his liability!!!!! WTF? Is it in my best interest to wait on the insurance company, or contact an accident attorney? State Farm obviously is not concerned with me. No rental car ... nothing ... just excuses ...

You're correct, the insurance company doesn't care about you. They will delay as long as possible, and the try to lowball you on the damages. You can hire an attorney if you want to. Otherwise, compile all the information you can about your car that you can (similar cars on eBay, local paper, CARMAX, etc.) Find cars with similar miles, condition and show it to the adjuster to negotiate a claim. Also, you should get a copy of your police report and provide it to the adjuster. That may get the ball rolling. Also, you can see if your insurance will help you out with your claim as a courtesy (sometimes an agent will do this for you.)
