Child injured on food establishment playset

My child suffered an injury while playing on a tubular plastic slide at a local (TX) food establishment. Should I expect the business to be involved in covering the medical costs without requiring attorney intervention?

If liability is clear, the food establishment is likely to offer assistance in resolving the medical so long as they are given a medical authorization (i.e. entry into your child's medical). Their offer will likely be limited to medical. Accordingly, your child might lose some money he/she is entitled to recover for other types of damages. Getting an attorney broadens the negotiation power and "could" get you more money. Food establishment usually does NOT want an attorney involved on your side so as to avoid these possible extra damages.

Just as you could treat your child's injuries yourself without a doctor and maybe wind up alright, you can treat your child's legal case yourself and possibly wind up ok. Why take that risk? Most attorneys will not charge you a fee unless they recover for you. My suggestion is that you telephone at least two or three lawyers, speak with them about the case (almost all initial personal injury consults are free anyway). You can get a better assessment of whether or not you want to tackle this yourself.
