Legal Question in Personal Injury in Texas
Civil Suit and Community Property State
My self-employed/unemployed husband has been served with a Civil Suit. Can my wages be garnished if the judgment is for the plaintiff? Should I divorce him to protect my retirement and income?

There are a number of possible issues that need to be discussed before a lawyer can give you a decent answer. You should try to find a local attorney that you can sit down with for an hour to discuss your concerns.

Generally in Texas wages are garnished only for child support. For the most part retirement accounts are exempt property and cannot be siezed. You need to consult with an attorney to make sure that these general rules apply to your specific fact situation.
