Legal Question in Personal Injury in Texas

Claim Disparity

Two people involved in fatal accident, expired persons children get $999,000.00 and survivour gets $ 1000.00 ? How can an insurance company not at least be held to pay for lost wages and incurred medical bills? I have about $40,000 in medical bills and my current lawyer says the responsible parties insurance can pay like they want as per Serrano vs ???? How can this be. I do NOT want to except the $1000.00 because I want to sue the insurance carrier so that they will at the very least pay my medical bills and lost wages (I was out of work for 5 months) forget about pain and suffering? Can some one help me out? Is my lawyer on the up and up?

unfortunately Ethics forbid comment by one attorney on other attorneys advice..but Insurers are not limited on how they distribute policy benefits..and hopefully you had UIM coverage...if not, who will pay ???
