Legal Question in Personal Injury in Texas

Collecting on law suit

We got into an accident with another vehicle in which we were not at fault. He did not have insurance so we had to pay to have our car repaired. We took him to court and won a law suit against him so he was supposed to pay us the cost to have the car repaired. His wife contacted us and told us they would pay $10 a month until they paid it off and we haven't seen a payment yet. Can we still do anything if the accident happened in October of 1995 and we went to court later that year?

Re: Collecting on law suit

You could abstract the judgment and buy a writ of execution for $200-$300. If he has any exempt assets, which doesn't sound likely, you could seize the asset for sale. The recording of the judgment would affect his credit if that is important to him.
