Legal Question in Personal Injury in Texas

Not sure if it would be considered personal injury

I am writing to ask if I possibly have a case against a man who murdered my ex-husband 10 years ago. The owner/boss killed 2 men at their place of employment, the case was tried and he was let go on self-defense because the men had bad histories with the law. My daughter now 10 years later is suffering from depression that has been diagnosed as being related to unresolved grieving of her dead father. She tried committing suicide along with other acting out behaviors. Now our family is separated and she is temporarily living with my ex-husbands side of the family (in hope that would help her emotionally), and she is off anti-depressants and counseling. She has always been a great kid and an outstanding student with good grades, which recently starting falling with the depression.

Do you think we have a case against the man who killed her father for her pain and suffering, the loss of her father, her suicide attempt, etc.?

It is a wrongful death case, and there is a one year statute of limitations. There may be axception to this if you daughter is under 19 years old she may be sue. The statute of limitations is tolled for a minor until one year after the minor reaches 18.

You would have to meet with an attorney to discuss all of the options and possibilities.
