Legal Question in Personal Injury in Texas
Continued pain after chiropractic treatment and withdrawal of attorney
I was involed in a rear-end collision in excess of 20mph. Sustained back and neck injuries. Had treatment with chiropractor for three months with some relief, but severe tightness between shoulderblades still present and subsequent numbness in left hand, particularly pinky finger. Chiro diagnosed whiplash, after treatment not helping had thorasic MRI come back negative. Attorney adamately pushed for settlement. I asked for some referrals for a specialist and attorney subsequently withdrew from case. Other insurance already established liability and wants to settle. Initial settlement before MRI procedure was for $3500, with med bills at $2069 and attorney fees of $1000. Now, med bills are at around $3334. Have pre-existing conditions from accident 8 years ago that attorney said was cause of problems now. Accident was in March of this year. Has anybody ever taken on an insurance co. without an attorney and prevailed? After I did not settle, the insurance co. denied the last two weeks of the rental car charges as they had init. been ok'd. Should I file a grievance with the State Board of Ins. and how should I proceed as far as my injuries are concerned?

Re: Continued pain after chiropractic treatment and withdrawal of attorney
Without an attorney you do not have the same clout because it is usually difficult for you to pursue your case in court. By all means, file any and all grievances for their conduct with the state board on insurance. Your medicals are very high now and the possibilities of settling this case will depend greatly upon your expectations.
