Legal Question in Personal Injury in Texas
Cottonwood tree
Has anyone ever sued a neighbor about a cottonwood tree. Which denies us the use of our backyard all summer effecting our quality of life and ruining thousands of dollars of landscaping.

Re: Cottonwood tree
Probably...it may be considered a nuisance and would cost thoursands of dollars....but before a lawyer would take his case, he would probably want a retainer to conduct research..Many suits are filed for waterflow, etc..and even for nuisances of neighbors actions....

You have a right to the airspace above your property. So, you might want to cut limbs crossing your property line. This may, however, cause you some trouble so you should consult with a local attorney in more detail before proceeding.
