Legal Question in Personal Injury in Texas

Dallas, texas.

my 8 yr old son was punched in the face by a child he does not know. for no apparent reason. the child ran and nobody seems to know who did it. i was not notified. i found out when my son called me after school. he said that he was sent to the clinic and the nurse told him there was no ice available. when i called the school, no report was filed and the nurse denied seeing him. what are my options? if they dont find the child, can the school be held accountable for anything?

It is next to impossible to successfully sue a school. Schools are protected by sovereign immunity which has been waived by the state for schools only in matters involving motor vehicles. School employees are also protected.

I'd suggest filing a police report. Another option would be to have your son write down what he did see before he forgets.

It sounds like your son was not serously harmed. It is unlikely that the amount you might recover would exceed the legal costs.
