Damages From Uninsured Drivers
Can I be awarded property (such as an automobile) as damages in a personal injury lawsuit if the defendant has no insurance?

A lot of personal property is exempt from award in a lawsuit; so an ordinary Texan is, therefore, usually pretty much judgment proof. So, the answer is likely no since a person of substance will usually have liability insurance.

You could get a judgment for the an auto if it were not exempt.
