my daughter was in an accident and the woman who caused it was under the influence of medication and on probation for dui. should i tell the insurance company this?

The insurance company should know this (it will need to be proven) but you should NOT be talking with the insurance company.
Insurance companies are businesses. They are motivated by profit/money. They have NO interest in being nice or helping people who have been injured. That doesn't mean that they are evil or bad; that is just what a business does. Insurance companies have professionals to talk to you to try to devalue your claim and try to make it look like the accident was at least in part your daughters fault.
