due diligence

i hd a accident 8/29/99 ,i filed lawsuit 7/2/01 aginst insurance co,person that hit me. insurance co filed to be taken off lawsuit because you have to have a judgement against the person before u can file aginst insurance co.. we went to court on august 20 ,01 i filed my ammended petition 11/13/01 now their saying i didnt use due diligenc.is their anything you can do to help me i go back to court monday coming please give me any legal advise u can anything arguements to look at what ever thank you very much

When filing a personal injury suit, the person who injured you is the party you sue, not the insurance company. Most personal injury attorneys take these cases on a contingency, which means that you pay nothing unless there is a recovery; in which case, the attorney will take a percentage of what is recovered. Get an attorney ASAP. There are attorneys listed in the phone book or call your county bar association.
