Legal Question in Personal Injury in Texas
Employer Gate damages vehicle, should I be help responsible?
I work for small security company in Houston and we have a small automated gate controlled parking lot. The gate is programmed to be open from 6am to 5pm mon.-fri. Earlier today after leaving some training I was pulling out of the parking lot right at 5 and a car was speeding down the road so I had to stop. Once the car went past I continued to pull out and I heard the scratching noise and sure enough when I looked back the gate had closed right on me. Like I stated before we are a security company and we have no safety loop or bumper pad on the gate. I have two questions 1) is there, or shouldn't there be, some sort of city code that requires some sort of safety on the gate to prevent this? 2) they are telling me I have to pay for the damage out my own pocket is this the way it should be or since there is no sort of safety device is it there fault?
