Legal Question in Personal Injury in Texas
False Insurance Information
I was driving down a street in a shopping center when a woman backed out of her parking space and hit my car from the passenger side, damaging the door and front right fender. She apologized for the event, saying that she has a mirror to shows her who is behind her, but she didn't see me. She gave me her insurance information, and when I called the insurance company (All State), they informed me that her policy had been cancelled. My insurance agent said that I can file a claim with my insurance company under Uninsured Motorists. My question is: Are there any legal reprecussions for providing false insurance information at the scene of an accident? Is she going to get away with this?

There are no real legal reprecussions for this. Be sure to get the denial of insurance coverage from All State in writing. You will need this for your UIM claim. Ron Vercher
Re: False Insurance Information
Your real damages lie with the collision, not her giving you false insurance information. Since you have uninsured motorist coverage, your best option is to make your claim under that and let your insurer sue this woman if it should so decide. If I were you, I would not waste any time pursing this woman. Yes, she is probably going to escape having to pay anything to you or your insurer for the damage she caused.
