Legal Question in Personal Injury in Texas

Fault? Road condition?

I was involved in a collision situation as follows:

The car in front of me hit a slick spot on wet road (Black Ice?) and lost control of vehicle. I hit this vehicle from rear when I step on my brakes and loose control also. Driver of car in front of me immediately exists vehicle looking at damage walks to my window asking what we should do. I tell driver a couple of times I think we need to move off of roadway (freeway exit off ramp). This vehicle is blocking my exit off of ramp. About this time I am hit from rear by driver who also hits slick spot in road. He hits me from rear and also knocks me back into vehicle in front of me. The driver in front of me receives no citation. I receive citation for failure to control speed. Driver behind me receives citation for failure to control speed. Accidents are written up as two seperate accidents because first driver exited vehicle. All drivers tell officer of slick spot on highway. Ticket mentions only wet road conditions.

I am having a great deal of pain in neck, back, and knee and am seeking treatment. What can you tell me about this situation and what is my best recours?

Re: Fault? Road condition?

From your description, it appears that you were traveling too fast for the conditions and failed to maintain a safe distance from the vehicle in front of you. You might try to pursue a claim against the driver behind you for his similar negligence.
