Friend Killed On The Job

I was wondering what percentage does a Personal Injury Lawyer normally charge to represent a case? A Friend of mines that was doing a delivery for his company, went to deliver at another company and was killed by a machine?

While the range of contingency fees charged by attorneys is usually between one-third and forty percent, far more important than the amount of the fee is the experience level of the attorney. I'm sorry to hear about your friend. To address your question, there are a few variables. First, is the employer a worker's comp subscriber? Second, did the deceased have a will?

To answer your question, most cases charge one-third of recovery if no lawsuit is needed, forty percent if a lawsuit it necessary. There is a separate procedure for the probate portion of the suit (establishing a personal representative to step into the shoes of the deceased in order to prosecute the case.) Many firms that do a number of death cases will do the probate portion for you at no charge, or charge it as an expense of the estate. I strongly recommend your friend's family interviewing at least two or three firms before they decide, as death cases require are typlically more complex compared to injury cases. Sorry to hear of the loss of your friend. Attorneys fees are dependent upon the complexity of the case and the level of experience of the attorney, in some cases. I suggest that your friend's family interview several attorneys in order to find a "fit".

Also, consider whether the attorney actually handling the case has trial experience or board certification in the area of law necessary. In my practice, fee agreeements are flexible depending upon the specific facts of each case.
