Legal Question in Personal Injury in Texas

I was hit by an Allstate insured driver on 04/03/10. Allstate inspected the car 04/09/10 sent me a letter saying they were working on the claim but could not say at the time that they would be paying the claim and that I should move my car to a Free lot. I live behind another house no wrecker would fit and have no free lot to take it to as they would not pay storage past 04/16/10. Besides the towing from the wreck, storage and another tow would have come from me before I could get my car released. On 04/27/10 they made a low offer, my car is totaled and said it would have been more but they are deducting storage fees owed from my offer. I thought once they excepted libility I had 5 days to accept? The car still racking up $20 a day in storage and no one will tell me if this is the law. I live in Texas

Allstate should be paying your storage fees as well as the entire value of your vehicle. If you have an attorney for injuries you sustained, you should ask them about handling the property damage claim. However, from my experience it seems that getting an attorney involved in the property claim makes a lengthy process even longer. You should alert your insurance company of the situation and they should go to bat for you. If you sustained any injuries and are not represented by an attorney, I would be glad to discuss this matter with you.
