hit by car while in the road

i was hit by a car while trying to get a truck out of a ditch. the accident report says it was my fault.do i have a case

You may have a case, though it would have to be investigated. Also, I don't know all the facts. Were you driving the truck, a passenger in the truck or were you towing the truck? Also, what kind of insurance do you have (full or liability only)? These facts make a difference.

While there may be rare exceptions, as a general rule, when the accident report is against you, your chances of winning the case are very, very slim. Like it or not, most juries place great weight on the opinion of the police officer. If the officer has concluded it is your fault, the odds of the jury finding otherwise are not very strong. You might want to talk to the police officer and see if you can persuade him to change his mind and amend his report. That, in my opinion, is about your only hope for success in this case.
