Legal Question in Personal Injury in Texas
i was hit by a very drunk driver in Novermber 2010. There was extensive damage to my 2008 dodge charger, and the driver was taken to jail. His insurance company covered cost of medical and repairs. We asked BEFORE repairs were done if there was any frame damage to car and were told no. Took car to Carmax 3 weeks ago, because am wanting to sell. Carmax immediately informed that the frame was damaged on car from wreck and repairs. This is a unibody car and once the frame is repaired as it was with a welded part, then the body is compromised, and the car's value to lowered quite a bit. we called the insurance company and they only want to give us the difference that they think is owed as of August, when the car was appraised by Carmax. They even admitted their inspector should have seen a number of things that was not repaired correctly. i feel as if i am being taken advantage of, and that my car that i have taken very good care of has been compromised as far as it's safety, and devalued. this vehicle should have been totaled. they paid the collission repair company over $8,000. how does that even make sense. what are my legal options?
