Legal Question in Personal Injury in Texas

I was hit in a motor accident and the result is a total loss of my car. I have not received any payment for what my car is worth but I am told by the insurance company of the person that hit me that they will not pay any more charges. Should I have a reason to fight for them to pay for the charges? I have been told that her insurance should cover the rental until I find a car. Any advice?
