Legal Question in Personal Injury in Texas
Hit and Run Felony
I was the driver of the Hit and Run Felony posted. My car was hit by a 20 yr. old with a 15 yr. old passenger. I was wearing a seatbelt but my girlfriend was not. I didn't sustain any injuries, but my girlfriend hit the windshield and broke it with her head. The 20 yr. old fled the scene but witnesses followed him and he was arrested. He also had other charges we are not clear of. The owner of the truck that the 20 yr. old was driving belonged to his ''uncle''. On the police report it showed he had insurance, but later found out through the insurance co. that they let it lapse. We are waiting for a written verification. I unfortunately didn't have insurance either. I understand that it was a consequence for not having insurance. My girlfiend had to go to the hospital by ambulance. She had head injuries and back and neck injuries. She does have medical insurance.
Waht do we do? Is there anything at all? Please Help.
Thank You.

Re: Hit and Run Felony
Take photographs of the damage done to your vehicle. You state that your girlfriend was a passenger in your vehicle. If she owned a vehicle that was insured and her policy had Uninsured/Underinsured coverage, then she should be able to make a claim under this coverage. She can also make a claim under the Personal Injury Protection coverage if she had it.
Most personal injury attorneys will review policies for clients without charge. So I strongly recommend that you contact an attorney that will read any policies your girlfriend has to advise you on what to do. If your girlfriend does not own a separate vehicle with coverage, then I would recommend that you contact the police department or the Department of Public Safety and ask them to send you a Crime Victim Relief Act claim form as she may be entitled to some benefits that are not covered under her hospitalization policy.
Again, I do recommend that you speak with an attorney on the telephone so that he or she can go over the details with you.
