This question really should be directed to your attorney. Insurance companies and juries usually do not value a "need surgery" case the same as a "had surgery". Most people are not aware of the length of time the case actually takes. It is not a simple matter of simply deciding to settle the case and get settled. The insurance company has a big role in how quickly a case gets resolved. The plaintiff does not control the settlement process completely.
Generally, faster the plaintiff must have the case settled, the lower the amount of settlement. All of this is something that you should discuss with your attorney.
Since you are represented by an attorney, rules governing attorney conduct do not allow us to discuss specifics of your case without your attorney's consent. Sorry, but you need to talk to you attorney regarding particular issues concerning your case.
