Legal Question in Personal Injury in Texas

MY husband of 32 years has had 3 work-related head injuries and been medically retired from his job due to those injuries. They have left him constantly dizzy, unable to cope with sudden changes in light intensity, anger issues, and severe memory problems to the point that he cannot remember sometimes what he had for breakfast. He insists he is fine to drive and that his doctors have not said he cannot drive. They just say it would not be "a good idea". So far I have succeeded in keeping him from driving (it has been 7 years) but my question is this--If he does drive & gets in an accident, what is my liability as his caregiver? Legally I am his wife, not his guardian but Social Security has already said that he is impaired to the point that he needs me to handle his paperwork.

You need to get as much auto insurance coverage as possible for your husband, including an excess policy to protect you and your husband's assets.

If you feel your husband is not competent, you may need to hire a lawyer and pursue a guardianship proceeding to give you authority legally stop him from driving.
