Legal Question in Personal Injury in Texas

I was injured on the job Sept 21, 2007. I work at nursing home. A resident knocked me off my feet and i fractured my L1 and fractured my right arm. I fell again March 20, 2008. I have been through therapy and continue under Dr care and on Medications for pain. Today, the insurance company called me and stated that their Dr. placed me at MMI. My own Dr has yet to release me. They offered me $4500 as long as I would sign termination papers. I told her no. She asked me what it is I would want. I feel like they really want me to be terminated and if I don't agree with them, then it will happen through my place of work somehow.

I know that I am a fall risk for the insurance company. I am 58 years old. There is no way that I could find another job with the same pay as I receive now, if I could find a job at all. I could possibly retire in 4 years. I have all my medical reports from the first injury to date. I am unable to do everything I used to do. It is bad when I cannot even lift and hold my youngest grandchild. My husband does all the sweeping and mopping of our house. And so much more has changed in my life. Is there anything I can do at this time?

I am assuming this is a worker's compensation case and your employer had worker's compensation insurance. No, I would not terminate. After reaching MMI, you may be entitled to extended benefits. You will need to discuss this with a worker's compensation attorney right away.
