Legal Question in Personal Injury in Texas

Injured and lost wages in auto accident

My son and I were involved in a car accident. The other driver was at fault. We went by ambulance to the hospital and were treated and released with abraions, burns, bruises, and my sons eyes were flushed. My son screamed in pain until his eyes were flushed, still sits in total stiffness in the car, and experiences twitching when we go past the accident site. My bruises were huge and very painfful but neither of us experienced long term injuries. I am wondering if he will nedd counseling in the future? Do we have a pian and suffering or mental anguish claim. Also, I was to start a new job the next day and was unable too. I called the employer and he stated he needed someone right away. Can I get compensation for this? I lost a whole job that took me 3 months to find. Jobs are scarce here for those who are not bilingual.

Both physical and emotional pain and suffering are compensable. Both depend upon appropriate treatment having been sought and obtained.

You son, at least, should investigate psychological counseling. The symptoms you describe are not uncommon under the circumstances you relate. Counseling can get him through much quicker than without it, and is a legitimate, compensable, injury.

A proveable lost employment opportunity is likewise compensable.

A good Personal Injury attorney would more than pay for his cost at this point, as most who try to do it themselves leave considerable money on the table.
