Legal Question in Personal Injury in Texas

I was involved in an accident where a diesel truck plowed into the side of me. They settled with me on my auto. I have been unable to settle with them on my medical. I am only asking for $4000

which I lost that much because of my mental stress from the accident, and it also caused me to be unable to work along side of my husband on our farm, raising cattle, and also helping with capentry

work. I was beat up, stiff and stoved up for weeks. How long does the company have to settle with me?

They keep offering very small amounts to settle, and I refuse. What are the steps they will take?

Based on what you have written, you need to determine what the medical damages are associated with the motor vehicle accident. Based on the value of the medical damages and the property damages, a settlement amount may be calculated. There is a statute of limitations for you to take legal actions against the other party or other party's insurance company. You should consider consulting with a local law firm to protect your rights and interests. Generally, motor vehicle accident claims must be settled within two years from the date of accident. If not resolved at that time, you must file a lawsuit in order to preserve your claim.

The insurance company will probably continue to offer you a small amount of $ until the two years runs out and then either tell you it no longer has to pay you anything or tell you just before the two year mark that you have to file a lawsuit if you want to keep your claim alive.

I handle claims thoughout the state. If I can help further, please let me know.
