Legal Question in Personal Injury in Texas

i was involved in an auto accident, the other driver was at fault, he received a dwi and failure to yield the right of way. the insurance company denied the claim because it was his sister car and she said she did not give him permission to use the car. my truck was totaled and i have body injuries. what can i do about this?

You are entitled to recover past and future medical expenses, past and future pain and suffering and mental anguish, past and future lost wages, and disfigurement. I'll echo the "call a lawyer" responses. I'll add that you may have other avenues of recovery. Since the sister sold out her brother, you can sue the driver and prevent him from getting a driver's license until he pays you. Also, you may have supplemental insurance that may cover this. Also, depending on where the driver was served, there may be a dram shop issue, allowing an additional type of recovery. It's complicated, but doable. Please contact a lawyer soon. Do you know where the driver got the alcohol from (e.g., commercial business, resturant, private residence, etc.)?
