Legal Question in Personal Injury in Texas

I was involved in an car accident with a woman who had no drivers license nor insurance. she has not called me to discuss the matter on how she is gonna pay for the damages to my car and she was at fault. what should i do to get her to pay for damages.

You can sue her in small claims court and get a judgment. If you send the judgment to DPS in Austin, they will not give her a license until she pays you. There is not much else you can do. If you had uninsured motorist coverage, then your insurance company would fix your car.

If you have full coverage, you can file a claim with your own insurance company to cover the repair bills and medicals. If you don't have full coverage, then you're stuck going after an unlicensed and uninsured driver. You can sue her, but you'll wind up with a judgment against someone with no money to pay it. You can also have her license revoked, but seeing as how she doesn't have one, it's not the best situation.
