Legal Question in Personal Injury in Texas

I've been involved in a hit and run accident. The guy that hit me was caught. However he is not insured on the policy for the car he was driving. So the insurance is going to deny my claim. Is there anything I can do to to make the insurance pay since the owner let him drive the car? I got whiplash and have to seek treatment for 10 weeks.

If the driver was permitted to drive the vehicle by the owner then the owner's policy covers your losses. Unfortunately you may need to sue the owner (and driver) to motivate the insurance company to pay for your losses. Your uninsured/underinsured coverage on your own policy may be worth invoking. Talk to a local personal injury attorney.

There is probably insurance coverage for your losses, even though the driver is not named on the policy. You will need to see that the driver that hit you is not a specifically named on the policy as an "excluded driver". You may need to sue the owner and the driver. You also might have uninsured or underinsured insurance coverage from your own policy. You should consult with an experienced attorney.
