Legal Question in Personal Injury in Texas
I was involved in rear end accident in Jan 09. Other driver's ins has paid for car and I have a personal inj attorney for medical. 8 months later I am told I need surgery. My attrny tells me it is best for me to put surgey 'quotes' into demand and settle now vs having surgery now and putting 'bill' in demand and settling after. (Surgeon does NOT wk with attnry and I am paying all out of pocket by choice and will file surgery on my health ins.) My question is does it benefit me to wait 4-6 more months in pain for a settlement to get more money in my pocket (as stated to me) or have surgery now and put bill in demand? I am confused and am unable to get answers. Can I give attrny 'quote' to put in demand and begin settlement and have surgery in the mean time?
