Legal Question in Personal Injury in Texas

job site injury

I was on a job delivering containers to a wind tower project in w.texas a worker there put a ladder on the side of my truck,it was windy as they were removing the chains from the load,the wind blew over the ladder and as it was heading for my head I put up my hand to block it,resulting in a dislocated thumb.Which put me out of work and caused me to fall behind on bills.workmans comp only pays so much..what are my rights in this situation?

If you can sue outside of worker's comp, then you can recover damages. You will have to repay worker's comp however.

Since you receive comp benefits, the insurance paying you will have first claim to any money paid by the negligent party who caused the accident. Most lawyers, and we are a firm which handles such claims, would not accept a claim against the negligant party in this case...as there would not be enough money recovered.
