Legal Question in Personal Injury in Texas
Kids Petting Zoo party in the backyard
Hey - we have a petting zoo party planned in our backyard. About 12 5yr olds are expected to attend with their parents.
How can I make sure that I or my home-owner's insurance does not have to pay for any medical treatment, should an accident occur. This can include a baby-animal biting a kid, a kid falling from the pony (they will bring in a pony for riding in the backyard), or a kid just falling on the concrete drive-way.
The petting zoo will include about 20 baby animals (rabbits, pigs, goats, ships) and a pony to ride. They come with all warnings signs, and fence so the animals don't run away!
Please advise if an existing form covers this, or should I get a lawyer write a custom form for this specific case.

Contrary to popular opinion, there is no "form" in Texas that can protect you from liability if injury results from your negligence. If you are not charging a fee to your guests, your homeowners policy will probably cover any claims. You have a "Med-Pay" provision that would pay medical bills up to a certain amount, regardless of whether you were negligent. (It is usually $5,000 per person.) Any other claims against you would have to be based upon negligence.

Just to supplement Mr. Street's very good answer, make sure that the petting zoo, etc. has insurance in force. They would be responsible at least in part for any of their negligence.
