Legal Question in Personal Injury in Texas
have a lawsuit right now against a multi-million dollar company and they have made an offer of a settlement. my lawyer is saying he gets 40% and i get 60% but out of my 60% i have to pay all the expenses ($12,000+) of this lawsuit as well as my doctor bills ($18,000) and surgery ($20,000) needed.

You need to look at the contract you signed with the attorney. In many cases, the contingent fee is of the gross recovery, not the net recovery. Medical fees come out of the client's share of the recovery, as those are costs that the client would have incurred even if there was no lawsuit.
