Legal Question in Personal Injury in Texas

Liability for someone without auto insurance

I was involved in an accident and did not realize that my insurance had lapsed. What are my liabilities? The person I hit has insurance but I don't know if he had UI coverage. In any case, I know that I am liable for all the damages and maybe even medical bills but I do not own property. I live paycheck-to-paycheck.

If the other party has uninsured motorist coverage (UM), the overwhelming likelihood is that they will not pursue you and will only seek damages from their own insurance carrier. It is possible the carrier will seek "subrogation" from you, but it sounds as if you are "judgment-proof," so I wouldn't lose sleep worrying about it. Please do get liability insurance, though, and also uninsured motorist coverage. After all, the next accident you have, the shoe could be on the other foot.
